Terms and Conditions
Please read carefully the following Terms of Use, which may be updated by Dojo from time to time. These Terms define your and Dojo’s rights and obligations. The most current version of these Terms can be accessed at any time at www.dojokenya.com/terms-conditions (The ‘Site’) Changes to these Terms will be notified via posting on the Site (or other written notice to you).
ACCEPTANCE OF TERMS OF USE
By accessing, browsing, and/or using the Site and/or the Dojo facility, you accept and agree to be bound to these Terms. In addition, when using particular Dojo services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time.
- WAYFINDER TERMS
The Wayfinder is a one-off promotion for first time users of Dojo only.
- This can only be purchased by one person, one time only. This promotion allows you access to any 5 of Dojo’s scheduled group classes or Zen Zone sessions as a trial offer.
- This promotion commences on the date of purchase and expires after 7 days. The Wayfinder is non-transferrable.
- This offer is only available for new clients who have not previously purchased a Dojo membership.
- Classes and Zen Zone sessions must be booked in advance and are subject to availability.
- This offer cannot be combined with any other promotions or discounts.
- Dojo reserves the right to modify or cancel this offer at any time without prior notice.
- The Wayfinder promotion is exclusive of Equipment Pilates, Personal Training, Massage Treatments and Kids sessions.
- DROP IN TERMS
A Drop In can purchase a one-off group class or open session for Ksh 2,500. This entitles the user to one session and use of the shower & changing room facilities. Towels are available at an additional cost.
- DOJO PASS TERMS
The Dojo Pass is your flexible ticket to exciting group fitness or open sessions.
Our Group Class Pass offers you the freedom to attend a variety of over 20 different group classes at discounted rates. Group classes could come in quick 30-minute bursts, balanced 45-minute sessions, and immersive 60-minute experiences.
We offer two fantastic packages to suit your schedule:
- 3 Class Pass: Valid for 3 weeks (3 group classes/ 3 open sessions)
- 10 Class Pass: Valid for 10 weeks (3 group classes/ open sessions)
- 3 class passes cannot be extended beyond the validity period specified for each package.
- 10 class passes can be paused for a maximum of 10 days.
- However, they can be shared with another person if you are unable to use them yourself. Please inform Dojo of the person you will be sharing your pass with in advance.
- Sharing of passes is limited to one person only and is subject to the discretion of Dojo management.
- Passes are non-transferable and cannot be sold or exchanged for cash.
- By purchasing a class pass, you agree to abide by Dojo’s terms and conditions and waiver of liability.
- Classes and open sessions must be booked in advance and are subject to availability.
- Steam/Sauna add-on is available for 2500/- for 1 hour. This is subject to availability and must be purchased at the time of booking.
- This offer cannot be combined with any other promotions or discounts.
All-Inclusive Perks:
As a Dojo Pass member, you’ll also have access to mats and class equipment, free face towels, including our changing rooms and refreshing showers. Need a shower towel? We’ve got you covered at an additional cost of 200/-
- OPEN SESSION TERMS
Open Session Passes give a client access to use the gym space and equipment for their own training after 10am. These sessions are not transferrable and must be used by the client who purchases them.
Open Session members have access to use the changing rooms & showers, however use of towels is at an extra cost. Members with an active Open Session package can purchase a group class for Ksh 1,800.
Open Session users must be mindful of other classes or personal training sessions taking place. The strength area, mobility room and outside area are all accessible, as well as all of the Dojo gym equipment. Call reception to confirm the availability of space.
Clients using the gym for open sessions should adhere to the gym rules displayed in the gym area.
- ZEN MEMBERSHIP TERMS (1 month, 3 months, 6 months, 1 year)
- Enjoy full access to Dojo with a 7-day schedule.
- Your Zen membership starts when you pay.
- Your Zen Card is for you alone and can’t be shared.
- If you buy a Zen Card, you’ll get a reminder email 28 days and 7 days before it ends. Renew it by logging into your account.
- For example, if you get a one-month Zen Card on April 5th, it ends on May 5th.
- You can pause your Zen Card by telling us in writing. You can pause a one-month card for up to 10 days. For three months, pause up to 25 days. For six months, pause for 55 days. And for a year, pause for 80 days, one month at a time.
- ZEN MEMBERSHIP COUPLE TERMS
- The Zen Couples Membership can be bought monthly, quarterly, every six months, or yearly.
- For couples who purchase Zen Unlimited memberships, both the purchase date and the date of renewal will be the same. This means that the memberships for both individuals in the couple will start and renew on the same date.
- All the rules for Zen Unlimited apply.
- A couple means any two people.
- ZEN MEMBERSHIP CORPORATE TERMS
- The Zen Corporate Card is for groups of 3 or more.
- You must purchase it for a minimum of 3 months.
- For groups that purchase Corporate Zen membership, both the purchase date and the date of renewal will be the same. This means that the memberships for all individuals will start and renew on the same date.
- All the rules for Zen Unlimited apply.
- CANCELLATION POLICY FOR WAYFINDER, DROP IN & DOJO PASS MEMBERS
An “early cancel” of pre-booked classes can be made with Dojo Reception or through the customer’s online account 3 hours before the class. You will receive a 100% refund of the class cost or the class pass to your account.
A “late cancel” of pre-booked classes is cancelling the class within 3 hours of the class taking place. This results in no refund of the class cost or class pass.
In the event of no-show of pre-booked classes, you will receive no refund of the class cost/pass.
- ZEN ZONE ACCESS (STEAM & SAUNA)
Zen Zone Access allows, two or three people of the same gender to use the steam, sauna and Zen Zone for one-hour total. This cost includes use of the changing rooms, showers and towels provided. The Zen Zone must be reserved before use, and one hour’s notice is required. If the booking is cancelled 3 hours before the reserved time slot, then a full refund will be made. If the booking is cancelled within 3 hours of the reservation, then this will result in a 50% cancellation fee.
- When using the Zen Zone facility all users must sign a waiver at reception and comply with the following regulations:
- Use the steam and sauna facilities in a respectful manner, ensuring the comfort and privacy of other club members.
- Understand that it is important to shower before using the steam and sauna facilities to maintain hygiene and cleanliness.
- Customers should follow the recommended temperature guidelines for the steam room or sauna. The typical temperature range for a sauna is between 77 to 88 degrees Celsius, while the typical temperature range for a steam room is between 43 to 49 degrees Celsius. It’s important not to exceed these temperature ranges, as doing so can be dangerous and increase the risk of heat exhaustion or dehydration. If a customer feels uncomfortable or lightheaded at any point, they should immediately leave the steam room or sauna and seek medical attention if necessary.
- Customers should avoid using hair and body products in the steam room or sauna. The heat and humidity can cause these products to vaporize and irritate the eyes, nose, and respiratory system of other customers. Additionally, the use of oils or lotions can create a slippery surface on the benches, which can increase the risk of falls and injuries. If customers need to use any products, they should do so before entering the steam room or sauna and rinse off any residue thoroughly before entering.
- Respect the club’s guidelines regarding nudity and maintain appropriate attire or use a towel or robe while using the steam and sauna facilities.
- Customers should never urinate in the steam room or sauna. This is not only unsanitary and disrespectful to others using the facility, but it can also lead to health hazards and the spread of bacteria and viruses. If a customer needs to use the bathroom, they should exit the steam room or sauna and use the designated restroom facilities. It’s also important to ensure that customers are properly hydrated before entering the steam room or sauna to minimize the need to urinate while using the facilities.
- Refrain from engaging in any behavior that may be considered inappropriate, offensive, or disruptive to other members.
- Keep the area tidy, do not leave towels lying around, laundry baskets have been provided for this.
- Food is not allowed in the Zen Zone.
- Phone calls and talking loudly is not allowed in the Zen Zone.
- MASSAGE TREATMENT TERMS
Appointments can be made via email, phone call or WhatsApp. All clients will have to pay a 50% deposit in advance to confirm their booking. Your appointment arrival time will be agreed to when you book. It would be appreciated if you arrive no more than 5 minutes early to ensure the previous client has time to leave. If you do arrive earlier, please take a seat at our reception or Revive bar as you wait to be called in for your session.
No-shows and last-minute cancellations are difficult for our business and it may mean other clients miss out. You can cancel or reschedule anytime via phone, or email with a minimum of 3 hours’ notice. Less than 3 hours’ notice may incur a 50% non-refundable cancellation fee. Any additional balance is non-refundable and can be carried forward for the next session.
- KIDS CLASS TERMS
Kids group classes are designed for different age groups and levels. These classes run for either 45 minutes or 60 minutes. Zen members receive a 10% discount on these bookings. Waivers must be signed before the start of the class.
Private one-hour sessions can be made for one or more children at an available time. If a group PT, all children of the group must be present for the discount to apply.
An “early cancel” is 3 hours before the kids’ session, and you will receive a 100% refund of the class. A “late cancel” is cancelling the class within 3 hours of it taking place. This results in no refund. In the event of no-show, you will receive no refund of the kids’ class.
- PERSONAL TRAINING TERMS
One person can book for single sessions or buy a package of 10 sessions. The 10 PT package is valid for 6 months. It cannot be frozen, transferred or extended.
Two or more people can buy a one-hour PT session that must be used at the same time and with the same trainer. All members of the group must be present for the discount to apply.
- Cancellation Policy: We understand that schedules can change. If you need to cancel or reschedule your personal training session, we kindly request that you provide at least 3 hours’ notice before your scheduled session. Failure to do so will result in the session being charged as if it were attended. To cancel or reschedule, please contact our reception or your coach directly.
- Package Validity: For every purchase of a 10-session package, the sessions will remain valid for a period of 6 months from the date of purchase. Sessions not utilized within this timeframe will expire and are non-refundable. We encourage you to make the most of your sessions within this period.
- Payment Policy: Please note that no payment, no service will be enforced. Payment for personal training sessions must be made in advance. Only after receiving the payment will the sessions be scheduled and confirmed. We accept various forms of payment, and our reception will guide you through the process.
- Booking Communication: To book your personal training session, you have two options: you can either communicate your booking through our reception desk or directly with your assigned coach. We recommend confirming your session details in writing to avoid any misunderstandings. The booking should include the date, time, and any specific requirements you may have.
- Health and Safety: Your well-being is our priority. Before beginning any personal training sessions, you will be required to complete a health assessment form. Please provide accurate and honest information to help us tailor the sessions to your needs and capabilities safely.
- Refund and Transfer Policy: All purchases of personal training sessions are non-refundable. However, we understand that situations might arise that require you to transfer your package to someone else. In such cases, please contact our reception to discuss the transfer process.
- Coach Availability: While we strive to provide you with your preferred coach, their availability may vary. In the event that your assigned coach is unavailable, we will make every effort to offer an alternative coach for your session.
- EQUIPMENT PILATES TERMS
Clients can purchase one group class, a pack of 10, or one private class or a pack of 10 private classes. Zen Members receive a 10% discount. Use of the changing rooms and showers are included. Towels are available at an extra cost.
All sessions (group or private) must be booked 24 hours in advance. An “early cancel” is 8 hours before the class, and you will receive a 100% refund. A “late cancel” is cancelling the class within 8 hours of it taking place. This results in no refund. In the event of no-show, you will receive no refund.
- REFUNDS
Unless expressly stated to the contrary herein, or as provided by applicable law, payments are non- refundable and there are no refunds or credits for partially used periods. This policy applies to all products sold on Dojo’s website. However, following your cancellation of your card you will continue to have access to the club through to the end of your paid cycle.
- OTHER FEES
Apart from the membership/class passes you pay for, there are no hidden fees. All our services are inclusive of VAT.
- MEMBER CONDUCT POLICY
By participating in any service offered at Dojo, you agree to adhere to the principles and standards set forth in this Policy. It is essential to maintain a respectful, cordial, and professional environment for all members.
- Respectful Conduct
Members and guests are expected to treat each other with respect, courtesy, and consideration at all times. Respectful conduct includes but is not limited to refraining from derogatory language, harassment, discrimination, or any behavior that may be deemed offensive to others.
- Professional Behavior
Professional behavior is expected from all members. This includes acting in a manner that aligns with the goals and values of our organization, treating fellow members, staff, and guests with professionalism, and maintaining a positive and collaborative atmosphere.
- Intervention and Risk Assessment
The Organization reserves the right to intervene in situations that pose a risk, discomfort, or threat to any of our members. This intervention may include issuing warnings, suspension, or, in extreme cases, termination of membership.
In situations involving inappropriate conduct, members may be subject to corrective actions, including but not limited to temporary suspension, or permanent membership termination, with no refund.
- Reporting Violations
Members are encouraged to report any violations of this Policy to the Organization’s management or staff. Reporting should include detailed information regarding the incident, individuals involved, and any supporting evidence to be sent to hello@dojokenya.com
- TERMINATION BY DOJO
You agree that Dojo, in its sole discretion and for any or no reason, may terminate any account (or any part thereof) you may have with Dojo or use of the Site and/or Club and remove and discard all or any part of your account or any content uploaded by you, at any time.
Dojo may also in its sole discretion and at any time discontinue providing access to the Site and/or Club, or any part thereof, with or without notice. You agree that any termination of your access to the Site or any account you may have or portion thereof and/or Club may be effected without prior notice, and you agree that Dojo will not be liable to you or any third party for any such termination, provided that, if Dojo terminates your account other than due to breach by you of these Terms, Dojo shall refund a pro-rata proportion of the fee paid for the Dojo card in which such termination takes effect.
Dojo does not permit copyright infringing activities on the Site and reserves the right to terminate access to the Site and remove all content submitted by any persons who are found to be repeat infringers. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of your use of the Site and/or Club may be referred to appropriate law enforcement bodies. These remedies are in addition to any other remedies that Dojo may have at law.
- REGISTRATION INFORMATION AND PASSWORD; SITE ACCESS
You agree that the information you provide to Dojo on registration and at all other times will be true, accurate, current, and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times. When you register, you will be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account.
- PRIVACY
Your privacy is important to Dojo. The Dojo Privacy Policy is hereby incorporated into these Terms by reference. Please read the privacy policy carefully for information relating to Dojo’s collection, use, and disclosure of your personal information.
- PROHIBITED CONDUCT
By using the Site, you promise to: Respect our facility; Respect our procedures; Respect our teams; Respect our customers; Respect our product.
- DISCLAIMERS; NO WARRANTIES
You agree that attendance at or use of any such classes, activities, or other services is solely at your own risk. In no event shall Dojo be liable for any injury, loss, claim, damage or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arises out of or is any way connected with a user’s attendance or participation in a class, service or appointment made through the site, or the performance or non-performance in connection with the services.
- LIMITATION OF LIABILITY AND DAMAGES
It is acknowledged that we accept no liability for the negligence of third parties. Under no circumstances, including, but not limited to, negligence, will Dojo or its affiliates, contractors, employees, agents, or third party partners, or suppliers be liable for any special, indirect, incidental, consequential, punitive, or exemplary damages that arise from or related to the use of the club and/or the site, including those that result from the use or the inability to use the facilities in the club or the materials on the site, or any other interactions with Dojo, even if Dojo or a Dojo authorized representative has been advised of the possibility of such damages.
Applicable law may not allow limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such cases, Dojo’s liability will be limited to the fullest extent permitted by applicable law.
